The Power Africa (PA) legal officer serves in an attorney-advisor role, providing overall legal advice and guidance to the Africa Bureau (AFR) and PA. In particular, the incumbent will work closely with the PA Coordinator's Offices in Washington, DC, and Pretoria, South Africa and with Resident Legal Officers throughout Africa on PA implementation issues. The incumbent will serve on the senior leadership team of PA. Some of the transactional activities planned by PA will involve the division within GC that provides legal advice to the Bureau for Development, Democracy, and Innovation (GC/DDI), which also works on energy, environment, climate and private sector engagement matters. The incumbent will assume a broad range of responsibility, consistent with her/his experience and expertise.
The incumbent provides overall legal advice and guidance to AFR and PA and other Agency offices, bureaus, and missions relating to the functions and work of such offices, including, but not limited to:
(1) USAID engagement with the private sector, governments and development partners to achieve PA goals for increased electricity supply and access in Africa;
(2) USAID management of the inter-agency initiative, including developing and maintaining working relationships with other U.S. Government agencies and international institutions;
(3) legal support for PA transactions, including credit guarantees and due diligence support;
(4) the application of law, regulation, policy, and guidance on USAID PA projects and activities (e.g., the Foreign Assistance Act, annual appropriations, the Electrify Africa Act);
(5) USAID contracts, grants and memoranda of understanding;
(6) congressional, GAO, Inspector General (IG), and public inquiries;
(7) initiating or commenting on proposed procedures and legislation, where appropriate;
(8) developing guidance and templates for USAID engagement with private sector entities in foreign assistance activities; and
(9) other duties as assigned.
